42.03 Interim custody

(1)

The Court may, pending disposal of the charge, order that the person charged:

(a)

be kept in custody as specified in the order; or

(b)

be released.

(2)

The order may require the person charged to give a specified amount of security for the person’s appearance in person to answer the charge.

Note:

The procedure in this Division can only be used if the alleged contempt has been committed in the face of the Court. This procedure will only be issued if it is necessary to deal with the conduct complained of quickly.
