108 Authority may require further information

(1)

If the Authority needs more information:

(a)

to enable it to assess an application and develop the relevant food regulatory measure, or the relevant variation of a food regulatory measure; or

(b)

to enable it to determine whether a charge under section 146 is payable to the Authority in relation to an application;

the Authority may request the applicant to provide it with such further information as is specified in the request within such reasonable time as is specified in the request.

(2)

If the applicant refuses or fails to comply with the request within the period specified in the request, without reasonable excuse, the application is taken to have been withdrawn. The Authority must give written notice of that fact to the applicant.

(3)

If an application is taken to have been withdrawn under subsection (2) after public notice of the application is given under section 28 or 51, the Authority must give public notice that the application is taken to have been withdrawn under subsection (2).
