112 Authority may rely on work or processes of other government agencies

(1)

The Authority may decide, in writing, not to do something that it is required to do under this Part in relation to an application made under section 22, or a proposal prepared under section 55, if the Authority considers that doing the thing would be a duplication of work already done, or a process already gone through, by another government agency.

(2)

If the decision relates to an application in relation to which public notice has been given under section 28 or 51, the Authority must give public notice of its decision.

(3)

If the decision relates to an application in relation to which public notice has not, or not yet, been given under those sections, the Authority must give notice of its decision to the applicant.

(4)

If the decision relates to a proposal in relation to which public notice has been given under section 58 or 75, the Authority must give public notice of its decision.

(5)

The public notice must:

(a)

identify the government agency referred to in subsection (1); and

(b)

contain a brief statement of the work the agency has done or the process it has gone through.

(7)

In this section:

government agency means:

(a)

a Department of State of:

(i)

the Commonwealth; or

(ii)

a State or Territory; or

(iii)

New Zealand; or

(b)

a body (whether incorporated or not) established by, or by a law of:

(i)

the Commonwealth; or

(ii)

a State or Territory; or

(iii)

New Zealand.
