78 Approving the draft variation in relation to high level health claims
After the submission period, the Authority must:
do one of the following:
approve a draft high level health claims variation;
abandon the proposal to vary the list; and
prepare a report under this section.
The Board must not delegate its powers to act on behalf of the Authority under paragraph (a)—see section 150.
The report must include each of the following:
the reasons for initially preparing the proposal;
a summary of the recommendations (if any) of the High Level Health Claims Committee in relation to the proposal and each draft variation that resulted from the proposal;
a summary of the submissions (if any) made by members of the Food Regulation Standing Committee in relation to the proposal and each draft variation that resulted from the proposal;
a summary of the submissions (if any) received by the Authority within the submission period in response to a notice under section 77;
the Authority’s response to the issues raised in those recommendations and submissions;
the Authority’s reasons for approving the draft variation or abandoning the proposal.
