Illegal Logging Prohibition Act 2012

The Secretary may publish on the Department’s website the following information:

the name of a person who has been convicted of an offence against subsection 8(1) or (2), 9(1) or (3), 12(1) or (2), 13(1) or (2), 15(1) or (2) or 17(1) or (2);

for an offence against subsection 8(1) or (2) or 9(1) or (3):

a description of the thing imported and of the illegally logged timber; and

the name of the country whose laws have been contravened;

for an offence against subsection 12(1) or (2):

a description of the regulated timber product; and

details of the due diligence requirements that were not complied with;

for an offence against subsection 13(1) or (2)—a description of the regulated timber product;

for an offence against subsection 15(1) or (2)—a description of the raw log that was processed;

for an offence against subsection 17(1) or (2):

a description of the raw log that was processed; and

details of the due diligence requirements that were not complied with;

such other details relating to the offence as the Secretary considers appropriate.

A reference in subsection (1) to a person who has been convicted of an offence includes a reference to a person in respect of whom an order has been made under section 19B of the Crimes Act 1914 in relation to the offence.

The Secretary may publish on the Department’s website the following information:

the name of a person who has been the subject of a civil penalty order under section 82 of the Regulatory Powers Act in relation to a contravention of subsection 8(3), 9(4), 12(3), 13(3), 15(3) or 17(3) of this Act;

for a contravention of subsection 8(3) or 9(4):

a description of the thing imported and of the illegally logged timber; and

the name of the country whose laws have been contravened;

for a contravention of subsection 12(3):

a description of the regulated timber product; and

details of the due diligence requirements that were not complied with;

for a contravention of subsection 13(3)—a description of the regulated timber product;

for a contravention of subsection 15(3)—a description of the raw log that was processed;

for a contravention of subsection 17(3):

a description of the raw log that was processed; and

details of the due diligence requirements that were not complied with;

such other details relating to the order as the Secretary considers appropriate.

The Secretary may publish on the Department’s website the following information:

the name of a person who has been the subject of an order under subsection 115(2) of the Regulatory Powers Act, to the extent that Act relates to subsection 8(1), (2) or (3), 9(1), (3) or (4), 12(1), (2) or (3), 13(1), (2) or (3), 15(1), (2) or (3) or 17(1), (2) or (3) of this Act;

a description of the undertaking given by the person;

a description of the nature of the breach of the undertaking by the person;

such other details relating to the order as the Secretary considers appropriate.
