38 Termination of appointment

(1)

The Minister may terminate the appointment of an Advisory Committee member:

(a)

for misbehaviour; or

(b)

if the member is unable to perform the duties of the member’s office because of physical or mental incapacity.

(2)

The Minister may terminate the appointment of an Advisory Committee member if:

(a)

the member:

(i)

becomes bankrupt; or

(ii)

applies to take the benefit of any law for the relief of bankrupt or insolvent debtors; or

(iii)

compounds with the member’s creditors; or

(iv)

makes an assignment of the member’s remuneration for the benefit of the member’s creditors; or

(b)

the member is absent, except on leave of absence, for 3 consecutive meetings of the Advisory Committee; or

(c)

the member engages in paid work that conflicts or may conflict with the proper performance of the member’s duties (see section 36); or

(d)

the member fails, without reasonable excuse, to comply with section 34 or 35 (which deal with the disclosure of interests).
