70 Recovery of scheduling charge and late payment penalty etc

(1)

Scheduling charge that is due and payable:

(a)

is a debt due to the Commonwealth; and

(b)

may be recovered by the Executive Director, on behalf of the Commonwealth, in:

(i)

the Federal Court; or

(ii)

the Federal Circuit and Family Court of Australia (Division 2); or

(iii)

a court of a State or Territory that has jurisdiction in relation to matters arising under this Act.

(2)

If a penalty for the late payment, or the underpayment, of scheduling charge is due and payable, the penalty:

(a)

is a debt due to the Commonwealth; and

(b)

may be recovered by the Executive Director, on behalf of the Commonwealth, in:

(i)

the Federal Court; or

(ii)

the Federal Circuit and Family Court of Australia (Division 2); or

(iii)

a court of a State or Territory that has jurisdiction in relation to matters arising under this Act.
