32 Review of certain awards and decisions

(1)

Section 109 of the Industrial Relations Act has effect as if:

(a)

references in that section to an award included references to an award made by a member of the former Commission or by the Flight Crew Officers Industrial Tribunal, within the period of 21 days immediately before the commencement, not being an award in relation to which an application for review was made under the previous Act before the commencement; and

(b)

references in that section to a decision to certify an agreement under section 115 of the Industrial Relations Act included references to a decision to certify a memorandum under section 28 of the previous Act made not earlier than 21 days before the commencement, not being a decision in relation to which an application for review was made under the previous Act before the commencement.

(2)

A review of an award or decision started on application under section 36A of the previous Act but not completed before the commencement shall, after the commencement, be dealt with under section 109 of the Industrial Relations Act as if the application had been made under that section.
