92F Provision for liabilities in the accounts of designated security trust funds

(1)

If:

(a)

a designated security trust fund is under judicial trusteeship; and

(b)

the Federal Court is satisfied that it is in the interests of the holders of contracts of insurance covered by the fund to make an order under this subsection;

the Court may order that the judicial trustee must, within such period after the making of the order as is specified in the order, make provision, or further provision, in the accounts of the fund;

(c)

of a specified amount; or

(d)

of an amount determined in a specified manner;

in respect of any or all of the liabilities secured by the fund.

(2)

The Federal Court may rescind or vary an order under subsection (1).

(3)

An order under subsection (1) does not require the judicial trustee to incur any financial liability by way of funding the security trust fund.
