131 Award of costs in Administrative Review Tribunal proceedings
The Administrative Review Tribunal may recommend to the Attorney‑General that the Commonwealth should pay the whole or a part of the costs, in relation to proceedings on an application made to the Tribunal under a provision of this Act, of the person who made the application or of any other person made a party to the proceedings under paragraph 22(1)(c) of the Administrative Review Tribunal Act 2024.
The Tribunal shall not make a recommendation under subsection (1) in relation to the costs of a person who applied for review of a pre‑acquisition declaration if the application has been dismissed under paragraph 101(1)(a) of the Administrative Review Tribunal Act 2024.
The Attorney‑General may, pursuant to a recommendation of the Tribunal under subsection (1), authorise the payment to a person of the whole or a part of the person’s costs in relation to proceedings before the Tribunal.
