44 Notice requiring acquisition

(1)

Where:

(a)

at least 28 days have elapsed since a pre‑acquisition declaration became absolute;

(b)

the declaration is still in force; and

(c)

the interest in land to which the declaration relates has not been acquired;

a person who is an owner of the interest may, by written notice given to the Minister, require that the interest be acquired.

(2)

If the interest is not acquired by an acquiring authority within 3 months after the giving of the notice, the declaration ceases to have effect at the end of that period.

(3)

The person may, in writing and before the end of the period referred to in subsection (2), agree to an extension of that period.
