50 Correction of compulsory acquisition declarations

(1)

The Minister may, by notice published in the Gazette, vary a declaration under subsection 41(1) for the purpose of correcting a clerical error, or an obvious mistake, in the declaration.

(2)

Where the Minister varies a declaration, the following provisions have effect:

(a)

if a copy of the declaration has been published in the Gazette, or in a newspaper, this Part has effect as if the copy published had been a copy of the declaration as varied;

(b)

the Minister shall cause a copy of the declaration, clearly showing the variation, to be given to:

(i)

each person to whom a copy of the original declaration was given in accordance with section 48; and

(ii)

any other person whom the Minister has reason to believe to be a person affected (within the meaning of subsection 41(6)) by the declaration as varied.
