When a maritime security plan is in force
52 When a maritime security plan is in force
If the Secretary approves the maritime security plan, the plan comes into force at the time specified in the notice of approval.
However, if:
the time specified in the notice is earlier than the time at which the notice was given; or
no time is specified in the notice as the time when the plan comes into force;
the plan comes into force when the notice is given.
The plan remains in force for a period of 5 years or such lesser period as the Secretary specifies in the notice of approval (which must be at least 12 months), unless before the end of that period:
the plan is replaced under subsection 54(4) or 55(4); or
the approval of the plan is cancelled under this Division.
