17 Acting appointments

(1)

The Minister may appoint a Board member to act as the Chair:

(a)

during a vacancy in the office of Chair, whether or not an appointment has previously been made to the office; or

(b)

during any period, or during all periods, when the Chair is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office.

Note:

For rules that apply to acting appointments, see section 33A of the Acts Interpretation Act 1901.

(2)

The Minister may appoint a person to act as a Board member:

(a)

during a vacancy in the office of a Board member, whether or not an appointment has previously been made to the office; or

(b)

during any period, or during all periods, when a Board member is absent from duty or from Australia, or is, for any reason, unable to perform the duties of the office.

Note:

For rules that apply to acting appointments, see section 33A of the Acts Interpretation Act 1901.

(3)

The Minister may only appoint a person to act as a Board member described in one of paragraphs 14(b) to (f) if the person is qualified to be appointed as the Board member described in the paragraph concerned.
