201A Delegation by the Minister to the Commissioner
The Minister may, in writing, delegate to the Commissioner his or her powers under section 209 to make National Disability Insurance Scheme rules for the purposes of the following provisions:
paragraph (b) of the definition of NDIS provider in section 9;
paragraph 67A(1)(db) (recording, disclosing and using protected Commission information);
section 67F (NDIS rules for exercise of Commissioner’s disclosure powers);
subsection 73B(1) (requirement to be a registered NDIS provider);
paragraphs 73E(1)(d), (e) and (f) (registration as a registered NDIS provider);
section 73H (conditions determined by NDIS rules);
paragraphs 73N(1)(d), (e) and (f) (suspension of registration);
paragraphs 73P(1)(d), (e) and (f) (revocation of registration);
section 73Q (record keeping by registered NDIS providers);
subsection 73T(1) (NDIS Practice Standards);
subsections 73U(4A) and (9A) (approved quality auditors);
subsection 73V(1) (NDIS Code of Conduct);
paragraph 73W(b) (complaints management and resolution system);
subsection 73X(1) (complaints management and resolution);
paragraph 73Y(b) (incident management system);
subsections 73Z(1) and (5) (reportable incidents);
paragraphs 73ZDA(3)(d), (4)(d), (5)(k), (6)(g) and (7)(e) and subsection 73ZDA(9) (NDIS Provider Register);
paragraph 73ZM(2)(h) (compliance notices);
subparagraphs 73ZN(1)(b)(iii) and (2)(a)(iii), paragraph 73ZN(2A)(a) and subparagraph 73ZN(2B)(c)(iii) (banning orders);
subsection 73ZOA(2) (anti‑promotion orders);
subsection 99(2) (reviewable decisions);
paragraph 199C(2)(i) (evidentiary certificates).
The Minister may, in writing, delegate to the Commissioner the Minister’s power under subsection 181Y(8).
When exercising powers under a delegation, the Commissioner must comply with any directions of the Minister.
