11 Operational control—basic rule

(1)

For the purposes of this Act, a person has operational control over a facility if:

(a)

the person has the authority to introduce and implement any or all of the following for the facility:

(i)

operating policies;

(ii)

health and safety policies;

(iii)

environmental policies;

and meets the requirements of the regulations; or

(b)

the Regulator declares the person to have operational control of the facility under section 55 or 55A.

(2)

Paragraph (1)(a) does not apply in relation to a facility if a declaration of a kind referred to in paragraph (1)(b) is in force in relation to the facility.

(3)

For the purposes of this Act, only one person can have operational control over a facility at any one time.

(4)

This section has effect subject to sections 11A, 11B and 11C.
