22 Defence for use of information in good faith

Section 21 does not apply if:

(a)

a person obtains protected information for a permissible purpose; and

(b)

the person makes a record of, or discloses or otherwise uses, the information in good faith:

(i)

in performing, or purportedly performing, his or her functions or duties under this Part on behalf of a responsible Commonwealth, State or Territory body; or

(ii)

in exercising, or purportedly exercising, his or her powers under this Part on behalf of a responsible Commonwealth, State or Territory body.

Note:

A defendant bears an evidential burden in relation to the matter in this section: see subsection 13.3(3) of the Criminal Code.
