38F Initial tester must report transfer of biological agent or sample for confirmatory testing

(1)

If the initial tester transfers the biological agent, or a sample of it, for confirmatory testing to a laboratory other than the initial testing laboratory or to another entity, the initial tester must give the Director‑General of the CDC a report that:

(a)

states that the initial tester has transferred the biological agent or sample; and

(b)

identifies:

(i)

if the transfer was to another laboratory operated by the initial tester—that laboratory; or

(ii)

if the transfer was to another entity—the entity and laboratory to which the transfer was made; and

(c)

is in a form approved by the Director‑General; and

(d)

includes the information required by the approved form.

(2)

The initial tester must give the Director‑General of the CDC the report within 2 business days after the transfer or such longer period as the Director‑General allows.
