Notices not to be tampered with or removed

In force

(1)

A person must not:

(a)

tamper with a notice while it is displayed under section 269; or

(b)

remove a notice that has been displayed, before the notice has ceased to have effect.

(2)

Subsection (1) does not apply if the person has a reasonable excuse.

Fault‑based offence

(3)

A person commits an offence if the person contravenes subsection (1).

Penalty: 30 penalty units.

Note:

A defendant bears an evidential burden in relation to the matter in subsection (2) (see subsection 13.3(3) of the Criminal Code).
