38 Master causing etc. breach of a condition of a seafarer certificate

(1)

The master of a regulated Australian vessel must not cause or permit another person to breach a condition of a seafarer certificate held by the other person.

Fault‑based offence

(2)

A person commits an offence if the person contravenes subsection (1).

Penalty: Imprisonment for 12 months or 60 penalty units, or both.

Civil penalty

(3)

A person is liable to a civil penalty if the person contravenes subsection (1).

Civil penalty: 600 penalty units.
