234 Section 90 (provisional improvement notices)
Section 90 of the Work Health and Safety Act applies as if the following subsection were inserted after subsection (1) of that section:
This section also applies if:
a health and safety representative reasonably believes that a person:
is contravening a requirement of a management plan; or
has contravened a requirement of a management plan in circumstances that make it likely that the contravention will continue or be repeated; and
either:
the requirement is in connection with the health and safety of any person; or
the contravention involves a risk to the health and safety of any person.
