48A Simplified outline of this Part

The CEO and inspectors have monitoring, inspection and enforcement powers under the Regulatory Powers Act to ensure this Act and the regulations are being complied with.

The Regulatory Powers Act creates a framework for monitoring and investigating compliance with this Act and the regulations, as well as providing for the enforcement of civil penalty provisions and the use of infringement notices, enforceable undertakings and injunctions.

This Part provides certain monitoring and investigation powers in addition to those provided by the Regulatory Powers Act.

Goods relating to contraventions of certain provisions of this Act or the regulations may be forfeited to the Commonwealth if:

(a)

a person is convicted of an offence, or a civil penalty order is made, in relation to the relevant contravention; or

(b)

the goods are seized under the Regulatory Powers Act.

The CEO may require a person to give information or produce documents that are relevant for the purposes of investigating or preventing:

(a)

an offence against this Act or the regulations; or

(b)

a contravention of a civil penalty provision of this Act or the regulations.
