101 Identity cards
The Minister must issue an Investigator a card identifying the holder as an Investigator.
An identity card must include a recent photograph of the holder.
An Investigator or is not entitled to exercise any powers under this Part if:
the occupier of the relevant premises has required the Investigator to show his or her identity card; and
the Investigator fails to comply with the requirement.
Offence
A person commits an offence if:
the person has been issued with an identity card under this section; and
the person ceases to be an Investigator; and
the person does not, as soon as practicable after so ceasing, return the identity card to the Minister.
Penalty: 1 penalty unit.
Subsection (4) does not apply if the identity card was lost or destroyed.
A defendant bears an evidential burden in relation to the matter in this subsection: see subsection 13.3(3) of the Criminal Code.
