Before making a numbering plan, the ACMA must publish on its website a notice:

stating that the ACMA has prepared a draft of the plan; and

setting out the draft; and

inviting interested persons to give written comments about the draft to the ACMA within 90 days after the publication of the notice.

If interested persons have given comments about the draft in accordance with the notice, the ACMA must have due regard to those comments in making the plan.

If the ACMA is of the opinion:

that a variation of a numbering plan:

will affect a number issued to a customer of a carriage service provider; and

is not a variation that, under a written declaration made by the ACMA under this subparagraph, is taken to be a minor variation; or

that it is in the public interest that the public should be consulted about a variation of a numbering plan;

stating that the ACMA has prepared a draft of the variation; and

setting out the draft; and

inviting interested persons to give written comments about the draft to the ACMA within 30 days after the publication of the notice.

If interested persons have given comments about the draft in accordance with the notice, the ACMA must have due regard to those comments in varying the plan.

A declaration under subparagraph (3)(a)(ii) is a legislative instrument.
