Telecommunications Act 1997

This Act applies to a partnership as if the partnership were a person, but it applies with the following changes:

obligations that would be imposed on the partnership are imposed instead on each partner, but may be discharged by any of the partners;

any offence against this Act that would otherwise be committed by the partnership is taken to have been committed by each partner who:

aided, abetted, counselled or procured the relevant act or omission; or

was in any way knowingly concerned in, or party to, the relevant act or omission (whether directly or indirectly and whether by any act or omission of the partner).

In this section:

a civil penalty provision within the meaning of the Spam Act 2003; and

a civil penalty provision within the meaning of the Do Not Call Register Act 2006.

the Telecommunications (Consumer Protection and Service Standards) Act 1999 and regulations under that Act; and

the Spam Act 2003 and regulations under that Act; and

the Do Not Call Register Act 2006 and regulations under that Act.
