12 Meaning of corresponding State‑Territory law

(1)

For the purposes of this Act, corresponding State‑Territory law means a law of a State or Territory:

(a)

whose operation involves the use of determinations made under section 18 of this Act; and

(b)

that is declared by the Commonwealth Minister, in writing, to correspond to this Act;

and includes such a law as amended from time to time.

(2)

A declaration under paragraph (1)(b) is a legislative instrument.

Note 1:

Section 42 (disallowance) of the Legislation Act 2003 does not apply to the declaration: see subsection 44(1) of that Act.

Note 2:

Part 4 of Chapter 3 (sunsetting) of the Legislation Act 2003 does not apply to the declaration: see subsection 54(1) of that Act.
