23 Persons bound by access order

(1)

A person who is not a party to the proceedings for an access order, or expressly bound by the order, is not bound by the access order.

(2)

However, a successor in title to an owner of land to which access is granted is bound by that order in the same way as that owner.

(3)

An access order does not confer on any party to the order any interest in the land to which access is granted sufficient to enable any such person to place a caveat on the title to the land under the Real Property Act 1900.
