9 Improvements carried out by owners without consent
(1)
It is a term of a tenancy that the owner may carry out an improvement on the farm without the consent of the tenant only if the improvement is first determined by the Tribunal to be suitable and desirable in the circumstances.
(2)
The tenant must pay fair compensation to the owner for an improvement carried out by the owner if compensation is determined by the Tribunal to be payable.
(3)
Compensation payable under this section may be paid in instalments together with any rent or other consideration payable in respect of the tenancy or in such other manner as may be agreed or determined by the Tribunal.
