40 Conciliation
(1)
The Commissioner is to refer a complaint made by a party to an apprenticeship or traineeship to a conciliator in the first instance.
(2)
The conciliator must attempt to bring the parties to a settlement acceptable to each of them.
(3)
If such a settlement is not achievable, the Commissioner is to deal with the complaint in accordance with this Part.
(4)
In this section—
conciliator means a person employed in the Department who is authorised in writing by the Commissioner as a conciliator for the purposes of this section.
