10G School does not operate for profit because of charitable fundraising
For the Act, section 83C(3), a non-government school does not operate for profit because—
the assets of the school’s proprietor, as far as the assets relate to the school, are used for the purpose of raising funds for a charity, if the use does not—
prevent the asset from being used for the operation of the school, or
otherwise adversely affect the operation of the school, or
a payment is made to a charity of funds raised for the charity if the payment—
is of funds raised by the school community, and
does not include—
the income of the school, or
the income of the school’s proprietor, as far as the income relates to the school.
