Declaration of property sector
48 Declaration of property sector
A local council classifies land to be within a particular property sector by declaring the land to be within that property sector.
A local council may change the classification of a parcel of land at any time by making another declaration.
A classification of a parcel of land ceases to have effect when a subsequent classification of the land takes effect.
A local council must change the classification of land that is in a property sector if the requirements for classification in that property sector change and, as a result, the land ceases to meet the requirements for classification in that property sector.
A local council may classify or change the classification of land on its own initiative or on the application of a liable person.
