Accrual of interest on overdue levies
83 Accrual of interest on overdue levies
Interest accrues on any levy or part of a levy that remains unpaid after it becomes due and payable.
Interest accrues on a daily basis.
The rate of interest is that set by the local council but must not exceed the rate specified for overdue rates and charges by the Minister administering the Local Government Act 1993 under section 566 of that Act.
If the local council charges interest on overdue rates and charges under the Local Government Act 1993, the rate of interest set by the local council must be the same as the rate of interest charged on overdue rates and charges.
Accrued interest is, for the purpose of its recovery, taken to be part of the levy that is due and payable.
Interest continues to accrue on an unpaid levy or part of a levy even though judgment for payment of the levy may have been obtained in a court. Interest is not payable on the amount of the judgment (exclusive of any order for costs), despite any other Act.
