7.28 Development on certain land in Londonderry
This clause applies to land identified as “Hawkesbury Reclassification” on the Clause Application Map.
This clause applies to the following development for the purposes of a specified land use—
the erection of a new building,
a change of use of an existing building,
development that will increase the gross floor area of an existing building.
Development consent must not be granted for development unless the consent authority is satisfied that the waste management facility to the north of the land has permanently ceased to operate.
In this clause—
specified land use means any of the following land uses—
dual occupancies,
dwelling houses,
home-based child care,
home businesses,
home industries,
schools,
secondary dwellings,
tourist and visitor accommodation.
