99 Requirement to register strata management statement
The Registrar-General must not register a plan as a strata plan that creates a part strata parcel unless the Registrar-General also registers a strata management statement for the building and its site or waives, under subsection (2), the requirement for a strata management statement.
The Registrar-General may waive the requirement for a strata management statement—
if—
the building is erected on a lot in a community scheme, and
only part of the building and site is to be subdivided by a strata plan, and
all of the residue of the building and site is to be community property within the meaning of the Community Land Management Act 2021, or
if—
the plan relates to part of a building that includes one or more part strata parcels, and
a strata management statement has already been registered for the building and its site, or
if a registered building management statement is in force for the building and its site, or
if the Minister, on the grounds the Minister considers sufficient, directs.
