Contributor entitled to defer benefit

(1)

A contributor is taken to have elected to take the benefit of Division 3A of Part 4 on the date that this Part first applies to the contributor, unless the contributor is otherwise entitled to a pension under section 27, 28, 28A or 28AA.

(2)

A contributor who is entitled to a pension under section 27, 28, 28A or 28AA on the date when this Part first applies to the contributor may instead elect to take the benefit of Division 3B of Part 4.

(3)

A contributor is entitled to take the benefit of Division 3A or 3B of Part 4, despite any provision of those Divisions.
