39.7 Sale to be by public auction
(cf DCR Part 35, rule 5; LCR Part 30, rule 15)
(1)
Subject to rule 39.13, property sold under a writ for the levy of property must be sold by public auction, by the Sheriff or by an auctioneer appointed under rule 39.8, to the highest bidder.
(2)
Property must not be sold by public auction for a price substantially below its approximate market value, as fixed by the Sheriff under rule 39.10.
