19 Indexation adjustments for 1 April 2026
The purpose of this clause is to make transitional adjustments to amounts subject to indexation on 1 April 2027 due to the commencement of the 2025 Act after 1 April 2026.
This clause applies in relation to an entitlement to compensation that exists on or after the commencement date.
On and after the commencement date, an amount specified in column 2 under a provision specified opposite in column 1 (a specified amount) must be taken to be the amount specified opposite in column 3 (an adjusted amount).
For the purpose of indexation under the 1987 Act, 1998 Act or 1942 Act, an adjusted amount must be taken to be the specified amount varied for 1 April 2026 for the purposes of indexation in relation to 1 April 2027.
For an amount other than a specified amount or adjusted amount that is also subject to indexation on 1 April 2027 and would have been subject to indexation on 1 July 2026 if the 2025 Act, Schedule 1.4 had not commenced—
the amount must be adjusted for indexation on 1 July 2026 under the 1987 Act or 1998 Act, whichever is applicable, as if the 2025 Act, Schedule 1.4 had not commenced, and
the amount adjusted under paragraph (a)—
is taken to be the amount on and from the commencement date, and
is taken to be the amount to be varied for 1 April 2026 for the purposes of indexation in relation to 1 April 2027.
The Authority must specify, by order published on the NSW legislation website no later than 3 months after the commencement of this clause, the adjusted amounts and other amounts adjusted by this division.

The order may include other information the Authority considers necessary.
In this clause—
1942 Act means the Workers’ Compensation (Dust Diseases) Act 1942.
commencement date means the day on which the 2025 Act, Schedule 1.4 commences.
