209F Contravention of undertaking
The Authority may apply to the District Court for an order if an insurer contravenes an undertaking given under this division.
If the Court is satisfied the insurer that made the undertaking has contravened the undertaking, the Court, in addition to imposing a penalty, may make one or both of the following orders—
an order directing the insurer to comply with the undertaking,
an order discharging the undertaking.
In addition to the orders referred to in subsection (2), the Court may make other orders the Court considers appropriate in the circumstances, including orders directing the insurer to pay into the Workers Compensation Operational Fund—
the costs of the proceedings, and
the reasonable costs of the Authority in monitoring compliance with the undertaking in the future.
This section does not prevent proceedings being brought for the contravention or alleged contravention of this Act to which the undertaking relates.
