8 Effect of recovery of damages from employer on payment of compensation
(1)
The amendment to section 151B made by the WorkCover Legislation Amendment Act 1995 to insert section 151B (4) is made for the purpose of avoiding doubt, and accordingly section 151B is taken to have been so amended from the commencement of that section.
(2)
However, that amendment does not affect any award of, or compromise or settlement of a claim for, damages made before the commencement of the amendment.
