176 Nothing to pass to or from prisoner
A person commits an offence if the person:
is a visitor at a custodial correctional facility; and
gives a thing to a prisoner; and
does not have the consent of the General Manager to do so.
Maximum penalty: 200 penalty units or imprisonment for 2 years.
A prisoner commits an offence if the prisoner:
is at a custodial correctional facility; and
gives a thing to another person; and
does not have the consent of the General Manager to do so.
Maximum penalty: 200 penalty units or imprisonment for 2 years.
Strict liability applies to subsections (1)(a) and (2)(a).
Subsections (1) and (2) do not apply if:
(a) the person is a priority visitor and the thing is a protected item; or
(b) the person is the prisoner's legal practitioner and the thing is a legal item.
