15 When non‑custodial offenders may be tested
A probation and parole officer who has authority to give a direction under section 172 of the Act must not direct a non-custodial offender to submit to a prescribed alcohol/drug test unless one of the following applies:
(a)
if the test is to detect the presence, or ascertain the concentration of, alcohol in the offender's body – the offender is prohibited under his or her non-custodial order or the Act from consuming alcohol;
(b)
the test is to detect the presence, or ascertain the concentration of, a restricted drug in the offender's body.
