292 Position of other conspirators no defence
It shall not be a defence to a charge of conspiracy that the person with whom the accused is alleged to have conspired:
(a)
has not been prosecuted;
(b)
has been found guilty of a different offence;
(c)
is not amenable to justice;
(d)
has been acquitted; or
(e)
lacked the capacity to commit an offence.
