43CD Geographical application – suspicion etc. that offence committed
(1)
This section applies if a person may exercise a power or perform a function under a law on reasonable suspicion or belief that an offence has been committed.
(2)
The person may exercise the power or perform the function if the person suspects or believes, as the case requires, on reasonable grounds that all the elements required for the offence exist.
(3)
Subsection (2) applies whether or not the person suspects or believes, or has any ground to suspect or believe, that the required geographical nexus exists for the offence.
