44 Validity of agreements
(1)
Two adults who are not married to each other may enter into a cohabitation agreement or separation agreement.
(2)
Except as otherwise provided by this Part, a cohabitation agreement or separation agreement is subject to and enforceable in accordance with the law of contract.
(3)
Nothing in a cohabitation agreement or separation agreement affects the power of a court to make an order with respect to:
(a)
the right to custody or maintenance of; or
(b)
the right of access to; or
(c)
any other matter relating to;
the children of the parties to the agreement.
