50 Acting without authority

(1)

A person commits an offence if:

(a)

the person intentionally makes a health care decision; and

(b)

the health care decision is in relation to an adult with impaired decision making capacity; and

(c)

the person is not a health care decision maker and the person is reckless in relation to that circumstance.

Maximum penalty: 400 penalty units or imprisonment for 5 years.

(2)

Strict liability applies to subsection (1)(b).
