9 Repayment of superannuation contribution surcharge
Despite any other provision of this Act, the Commissioner may:
(a)
commute part of a member's pension under this Act to a lump sum in order to pay the balance of the member's surcharge debt account;
or
(b)
deduct an amount equal to the balance of a member's surcharge debt account from any payment to be made under this Act in relation to the member.
