7 Dead animals on street, &c.

(1)

A person who, in a public place or vacant Crown land, causes the death of or injury to an animal so that it cannot remove itself shall forthwith remove the body of the animal or the animal, as the case may be, from any part of the public place or vacant Crown land that is used by vehicular or pedestrian traffic.

Maximum penalty: 4 penalty units.

(2)

It is a defence to a prosecution for an offence against subsection (1) if the defendant satisfies the court that it was not practicable for him to remove the body of the animal or the animal, as the case may be, from where it was and he gave notice of the occurrence to a member of the Police Force as soon as practicable after the occurrence.
