22.12 Affidavit witnessed by party etc.

(1)

Unless the Court orders otherwise, an affidavit witnessed by:

(a) the law practice acting for the party on whose behalf it is to be used; or

(b)

an employee of the law practice,

may be used in evidence.

(2)

Subject to subrule (3), an affidavit witnessed by:

(a)

the party on whose behalf it is to be used; or

(b)

an employee of that party,

is not to be used in evidence without the leave of the Court.

(3) Where the Territory is the party on whose behalf the affidavit is to be used, the affidavit may be witnessed by an employee of the Territory.
