40.04 Service where practitioner ceases to practise

(1)

Where a legal practitioner who has acted for a party has ceased to practise and the party has not given notice under rule 40.01 or the legal practitioner has not given notice under rule 40.03(1), on an interlocutory application made by any other party to the proceedings, the Court may give directions for service of documents on the party.

(2)

Where an order is made under subrule (1), the party who made the application must without delay serve a copy of the order on each other party to the proceedings and file an affidavit of service.
