5.05 Names of parties
(1)
A person who commences proceedings by filing a statement of claim is the party called the plaintiff and the person against whom the proceedings are commenced is the party called the defendant.
(2)
A person who commences proceedings by filing an originating application or other application is the party called the applicant and the person against whom the application brought is the party called the respondent.
